A healthcare directive speaks for you when you cannot speak for yourself. Without one, someone else will.
ยง Overview
Healthcare directives are legal documents that express your medical care preferences when you are unable to communicate them. Every adult should have them โ yet most Americans don't, and families pay the price in agonizing decisions and family conflict.
Healthcare directives come in two primary forms: an advance directive (or living will), which states your wishes for specific medical interventions like resuscitation, ventilators, feeding tubes, and comfort care; and a healthcare power of attorney (or healthcare proxy), which designates a person to make medical decisions on your behalf. These documents work together โ the advance directive tells healthcare providers your preferences; the healthcare POA designates someone to interpret and implement those preferences in situations the directive doesn't specifically address. Without both, medical decisions fall to family members by default (which can cause devastating conflict), or to the healthcare team acting under strict protocols that may not align with your values.

ยง How attorneys approach this
โThe most important element of a healthcare directive is the conversation, not the document. Family members who have discussed their loved one's values and wishes โ who understand not just what they want, but why โ are far better equipped to advocate in a medical crisis than those presented with a document they've never read. The legal documents matter enormously, but the conversation that surrounds them matters even more. An estate planning attorney who views healthcare directives as a box to check is missing the point. The document should reflect genuine reflection and real communication.โ

Q 01
A living will (or advance directive) is a document in which you state your own preferences for specific medical interventions โ it speaks in your voice about your wishes. A healthcare proxy (or healthcare POA) designates another person to make decisions on your behalf โ it empowers someone else to speak for you. Most complete estate plans include both, since no document can anticipate every medical scenario and someone needs authority to interpret your wishes in real time.
Q 02
A properly executed advance directive gives healthcare providers legal authority to follow your documented wishes even over family objections. However, the practical reality is that medical teams prefer consensus and often pause treatment to involve ethics boards or facility administrators when families object. Discussing your wishes with family in advance โ not just leaving a document โ is the most effective protection. If you anticipate serious family conflict, naming a non-family healthcare agent may be appropriate.
Q 03
Yes, and this is critically important. A diagnosis changes the realistic scenarios you're planning for. General language like "no heroic measures" means something very different before and after a serious diagnosis. Work with your physician and attorney to review and update the directive after any significant health event, annually after age 70, and any time your values or treatment preferences change.
Q 04
In most states, a properly executed advance directive is legally binding on healthcare providers. Physicians generally cannot override a clear, applicable directive without good cause. However, a hospital or physician may decline to follow a directive that violates their conscience or institutional policy โ in which case, they must inform you and facilitate a transfer to a provider who will comply. Having a designated healthcare agent with authority to advocate and insist on compliance is essential.
