A prenuptial agreement is a contract entered into before marriage that specifies how assets and debts will be divided if the marriage ends in divorce or death. It is not just for the wealthy โ€” any couple with significant assets, business interests, children from prior relationships, or financial imbalance can benefit.

A prenuptial agreement (or antenuptial agreement) can cover property division, spousal support, debt responsibility, and the treatment of future inheritances or business growth. It cannot cover child custody or support โ€” courts will not enforce those provisions, as the child's rights are determined at the time of divorce based on current circumstances. For the agreement to be enforceable, both parties must fully disclose their assets and debts, both must have independent legal counsel, and the agreement must be signed well before the wedding โ€” courts scrutinize agreements signed days before the ceremony.

Does asking for a prenuptial agreement mean I don't trust my partner?

Not at all โ€” though that is the most common emotional response. A prenuptial agreement is a financial planning document, not a prediction of divorce. Can a prenuptial agreement be changed after marriage?
